  • Calculating California Use Tax

    The instructions that come with the California Sales and Use Tax calculation
    forms specify that use tax should be calculated on purchases from out of
    state retailers. What is strange to me is that the instructions stay
    completely silent on whether use tax is due no purchases of used equipment
    from out of state *individuals* who are not in business as resellers. Does
    the formal law speak to those kinds of purchases? Use tax must be
    calculated on those as well?

    I read that use tax is not owed when the out of state seller has agreed by
    contract to pay any use tax that is due. What form must this contract take
    for it to be acceptable to the California authorities?
