can she get removed from the house for this? Nebraska

My stepmom has been both physically and mentally abusing my dad. I moved out because she was making unsafe for me to live there anymore, but he wont leave. He's trying to get her out for both types of abuse and for child endangerment. The lawyer said the court probably won't remove her from the house. We both can't figure out why they won't remove her. I would think because of what she is doing they would remove her, but they lawyer highly doubts it. I was just wondering what other opinion on this is. I don't think it's fair because shes making it unsafe for him to live there now to and they won't do anything about it.
