    You would have to be married (usually for at least one year) before you could adopt the child. It is true that parental rights will not be terminated at this point. There are other conditions that TPR can be done, but nothing in your situation meets those conditions. Regardless of any abuse, abandonment, extreme neglect, etc., yes, in your state, there must be a step parent willing and able to adopt. The court will not leave a child without a legal parent (mother or father), if it can be avoided.
