    He could easily file an ex-parte order and get temporary custody.

    That happens not infrequently.

    Unrelated to the OP, but do you at least have a child support order against him? Even if you never actually get the money, he should have that hanging over him for the rest of his life.

    Her father and I have a couple of mutual friends that have already told him that I am leaving. Though he has never cared about supporting her, he is admittedly spiteful enough to try and take her to cause me pain.

    I am scheduled to leave the country for 30 days beginning on June 1. The trip is for a college study abroad course. My 3 yr old daughter is to stay with my fiance, who has also been the closest thing to a real dad shes had in 2 years. Im concerned that her biological father, who is on the birth certificate and was legitimized, could show up and take her while I am gone. He has never supported her, nor have I heard from him in a year. Is it legal for me to leave for 30 days and leave her with my fiance? Could her biological dad take her, legally?
