It is entirely possible that your fiance/husband could be a negative factor. There is no cut and dry criteria but getting custody of a sibling, or really away from any parent who wishes to parent, is extremely difficult. It takes much more than a negative home environment. Granting custody to a 25 year old is not going to be done lightly and of course, your life will be under scrutiny as well as that of anyone in the household. Frankly, if fiance is that expendable, I would think twice about keeping him in the picture when you attempt to bring a 12 year old from a difficult background into your life. The child needs stability and an ex-con fiance who could be out the door at any time is not going to provide that.

My fiance was convicted of 3 counts burglary when he was 19 years old, he is now 26. He is out of state custody and is off parole. We live in Nevada but my little brother (who is 12 and I am 25) lives in Oregon. His living situation with my mother is highly unhealthy both mentally and physically for him. I want to fight for custody since I have the means to provide for him and I know my fiance would be a positive influence on him but I am unaware if he would cause me to lose my chance to get my brother away from my mother because of his felonies. I know that normal adoption would say no but since this is a custody case and I am his sister I was wondering if it would be different or if I need to call off my engagement. All I want is my brother to be safe and I will do what I need to do to make sure that happens. Any help or advice would be greatly appreciated. Thank you.Tags: None
