  • Wrongful Termination Texas

Performance review on Monday which did not mention anything about my work performance being bad that would result in termination. On Thursday the same week I was terminated stated for job performance. Would this be considered wrongful termination? The manager that terminated me told everyone that I quit.

A wrongful termination means that you were fired in violation of a law that would otherwise have precluded your termination. Unless you had an employment contract stating otherwise, you were an at-will employee who could be terminated at any time for any reason not prohibited by law. So, based on what you've posted, this was not a wrongful termination.
I am not able to respond to private messages. Thanks!

As stated, the termination was not wrongful. However, if you are going to attempt to get UI benefits, it will need to be very clear that you were actually fired (not for misconduct) and did not quit.

No, this is not a wrongful termination.

If you had on-going performance issues that were not discussed in Monday's review, firing you out of the blue for poor performance is a really lousy deal but it's not illegal.

Perhaps your manager told everyone that you quit because he [rightly] believes that your being fired for performance problems is nobody's business but yours.

Did you make a big mistake between the performance review and the termination that could be the case of the termination?
