    please help! the co. my sister works for says they are letting her go because they are getting rid of her position in the co. here where the trouble starts....she is doing the job of an graphic artist but does not have the job title. she has worked there 16 yrs. and has done all of the graphic arts for this co. this is all she has ever done. her boss and her had a arguement, now he want to get rid of her position and hire a graphic artist.
    i was told if they do this, the grap. art. they hire must have diffrent job expectation then what she has been doing, if his or her job will be doing the exact same thing she is doing, it's illegal. is this true? by the way she has never had a write up, all her reviews are great, her boss under the one that is mad at her told her she didn't want to let her go and he was wrong.
    she will be losing her 401k and all of her insurance. what can she do

    Her employer is doing nothing illegal. Unfair is not always illegal

      No, what you were told is not true. Sorry.
      The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.

          What do you mean she will be losing her 401k - she shouldn't be losing that. Re her ins. if the employer had group health ins. & has 20 or more employees she should be offered COBRA to continue her ins. at her own cost. If there are less than 20 employees, she should qualify for the Ohio equivalent.

          She can file for unemployment ins. & look for another job.

          Sorry but nothing illegal re the termination.
