    I would advise you to consult with a lawyer particularly before accepting or declining a settlement. Whether it is in your best interest or not is something that should really be discussed with them in light off all the medical facts.

    If you reinjure yourself at the same job, and it is a totally new injury, your employer is still liable for it. If you have left employment with them and have a flare up or injury at your new employer's, it should still be covered but how and by who can get dicey.

    If your condition deteriorates over time and requires additional medical care, that care is covered unless you have signed a settlement agreement that closes out your case.

    this Doctor was the second Opinion already.....I mis-used the word "make" but yes he is saying that i will be permantly partialy disabled.......so is it better to settle because I Heard that if I re-injure that portion of my body the company would consider it a new injury even if it was caused by the prior injury and they would not be at fault.......any help here??

    Your doctor doesn't "make" you disabled for life. It may be his opinion that you are so, or that even after you reach maximum medical improvement you will still be so. Once you have reached MMI, and go to either settle or receive permanent partial disability for your claim, part of what will be looked at is what affect this has had on your career and life in general.

    You can request a second opinion and in fact, the WC carrier will probably send you for one even if you do not.

    Workers Comp in CA

    I have been on workers comp for a year already. I injured my knee and have had two surgery's on it and still is not fixed. I have been refered to two diffrent specialists. My quality of life has suffered....ie I can not stand for more than a few hours or walk for periods of time. I can not kneel or squat anymore. The second specialist is now saying that he is going to make me partialy disabled for life.........Do I accept this or ask for another opinion? If i accept it what does this mean for me $ wise? The company did accomidate me by taking me out of the field and putting me into a desk job......help
