    I live in ca. my husband is on work comp he has to have a knee replacement
    due to an injury at work. He lost his other leg above the knee in a motor cycle accident 30 years ago, he has worked for the company this whole time[30 years] My question is can I have work comp pay me to stay home wiyh him while he is unable to care for him self? I was going to take fml but they only cover 6 weeks paid and I would have to be gone longer tha that by a couple of week and cant really afford the time off. I also work for the same co. for 20 years.

    I will be utterly astounded if workers comp will pay you to stay home with him, but wait for Michael to check in - don't take my word for it. Workers comp is not my strongest area and California has surprised me before.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.

      WC might pay for a home health nurse, but I've never heard of them paying the wages of a third party who wished to be off work with an injured family member.
