  • CA-soccer injury at work during lunch

We are a silkscreen printer in California. Our employees play soccer during their lunch or break time in the back of the building. One employee got hurt while playing and I would like to know if we are liable for his injury although it is not work-related. Do we have them all sign a waiver or release of all claims? Do we object to them playing soccer?
    Please help.

    Lunch Break Injury

I looked all through the workers compensation website for California and couldn't find anything that discussed this topic. I know, from personal experience of managing the workers compensation function for several large corporations, that some states take a more liberal view on the matter than others. For example, we had a case in Virginia where the employee slipped in the parking lot after work. We were held liable. However, there is a case in Illinois where the person was dancing at work during a break. That person's injury was not covered.

My suggestion is that you contact the state and ask them. Please let me know what you learn. It will be interesting. http://www.dir.ca.gov/CHSWC/Injured_...actsheets.html
