  • Premiums to pay to which State? New Mexico/CO

    I have a question regarding the payment of WC premiums. If an employee lives in one state (NM or CO) and the company home office is in NM, and the employee may work some of their time in NM and some in CO what state do you pay the WC premium to? The industry this is in is Home Health Care.

    Where they are based out of. If they work out of their home, i.e., they don't go into an office every day, go directly from their home to the client and back, then their "base" would be where they live. Same for taxation.
