  • MISC.....Employer taking out owed taxes from 05'

    My employer never took out the right amount for my taxes in 05'. I work in NJ, but live in PA. At the end of the year I still owed 885.00 The beginning of 06' my employer started taking out the amount ($32) per check. I just recently entered another job, w/ a different company. On my last check, my employer took out the remainder of the amount (620). I never signed an agreement w/ my employer. Is he allowed to do this?

    What type of tax are we talking about here? Why was the "proper" amount of tax not withheld?

      The PA taxes. I started on Jan 17th of 05'. My employer never took out PA taxes until June of 05', I repeatedly asked him to take out the proper taxes.

        He can't go back and collect PA income taxes from you unless 1) you agreed in writing and 2) he paid the tax to PA that should have been collected in 2005, reported the amount that should have been deducted on your W-2 form.

        If both these criteria are not met, contact the state Dept. of Labor and file a complaint for an unauthorized deduction.
