  • CT lunch breaks for salary employees

    Are salary employees entiteled to a 30 minute lunch break in the state of Connecticut? My husband is a salary employee. The pay he receives does not change no matter how many hours he works in a week. He generally works approximately 50 hours per week. He has been given a hard time about taking a lunch break. Is he exempt from the 1/2 hour break that hourly emplyees receive if they 7 1/2 hours in a day?

    The CT DOL web site does not specify that only non-exempt employees are covered by the break regulation; however, there are several job-specific exceptions in which an employer may be exempted from the requirement. There is no way of knowing, based on what you have posted, whether any of those exceptions apply. Also, giving him a hard time about taking a break is not the same as refusing to allow him to take it.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
