Yes, it can be done legally.

As long as the job duties do not change so that he still qualifies as exempt, and as long as his salary is not cut to less than $455 per week, there is no reason why he cannot still be paid on a salaried basis, just with the salary reduced to reflect the shorter work week. The law does not say that if you work less than 5 days a week, you have to be paid as hourly.

Salaried employee going to 4 day work week - SC

My husband has worked for a manufacturing co in SC for the past 5 years. He is the plant manager and is salaried. (Getting paid a set amount no matter how many hours he has worked in a week.) The company is hurting financially and they have decided to make all salaried employees go to a 4 day work week thus reducing their pay. First of all, can this be done legally and secondly, how should their pay then be figured (salary vs hourly ???)
