  • pay check screwup

    IM from california and this is my situation. My company over paid me in my pay check with overtime, they gave me overtime in my check for no reason, it was an error they made, but i didnt know that. The day that I'm supposed to receive my check, the company deducted all the extra money from the check, they hold the left over of my check. I have to make car payments. Can the company hold my check for about a week?

    Why is it you did not know you were paid overtime in error? Do you know now that it was an error? There are some strict guidelines in California about recovery of overpaid wages, which include, if I recall correctly, getting your written authorization to reduce your subsequent pay in the amount of the overpaymet. However, I have to wonder why you didn't know about this. By law, your paystub has to show regular and overtime hours/pay separately. How much are we talking about here?
