  • i was suspended w/out pay during my lunch hr for reading a newspaper, calif

    i was suspended w/out pay for 3 days for reading a newspaper during my lunch hour while a senior manager spoke in the lunch room.
    >
    I thought an employer relinquished there rights when a employees lunch hour began and regained control of the employee when it was over for example;
    ( lunch break 11:00 a.m. to 11:30 a.m.)
    >
    They said it was a violation of my companys ( philosophy & policy )?
    >
    This was not a mandatory meeting, everyone was not required to attend, employees sat outside on the patio smoking and eating at this time.
    >
    I couldn't find anything to address this question using the search function
    >
    do i have recourse??
    .
    thanks you for your help lou

    Nope, sorry.

    Just because you were on your lunch hour doesn't mean you are entitled to ignore a senior manager who is speaking to you, regardless if it's the individual you or the collective you.

    Not to the extent you took it.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
