  • Regarding tips

    Where I work , when we get tips we have to put them in a jar . And everynight the owner takes it and says he puts it in a 401k plan and supposedly if we actually last a year there we're supposed to somehow benefit from them . Everybody has always thought this was illegal but nobody knew where to go to find out . I just found this messageboard and thought I'd ask to see if anyone knew . Does anybody know and if not does anybody known who I could ask ?

    The cash tips belong to the servers. And, just for curiosity's sake, since you are not getting the tips, is he then paying the servers at least the full minimum wage? If he is appropriating them, that IS illegal. Putting it in a 401(K)? HAH! If you didn't give him authorization to deduct from your pay (which tips are) that is not allowed by any state. Do you get 401(K) statements? I doubt it.

    Contact your state Dept. of Labor regarding not getting your tips, and you can also contact the U.S. Dept. of Labor regarding the 401(k) issue. This sounds fishy at best and criminal at worst.
