  • CO: No funds in Flexible Spending Account

    Worked for a company that has downsized 2/3 of its employees. Almost all of the employees who were contributing to the FSA have been downsized. A number of us who used to work there had submitted medical bills before we lost our jobs and have not yet received reimbursement.

    The company administering the FSA says that there is no money in the account to pay anyone since no one is contributing anymore. Isn't the company liable for this? What do we do? Thanks!

        Sounds like there may be a violation of the regulations here. However, I'm not sure to whom this would be reported, but I'm thinking it's an ERISA issue. Beth, cbg?
