  • Florida vacation policy

If you resign your position and have vacation time at the time of you quitting, does the employer have to pay you for that time???

This employer's handbook states, use it or lose it, no carry overs as well as that they will not pay you any unused vacation, regardless of how you leave employment (voluntary resignation, termination, etc.).

Florida has no law requiring the payout of vacation time at termination. Your employer's policy is legal in your state.
The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
