What is the minimum hourly rate for a Computer Professional in the state of Indiana?

  • #2
This is a tricky point, and by the way it's Federal law, not state.

A computer professional WHO IS PAID ON AN HOURLY BASIS must be making $27.63 to qualify as exempt.

However, a computer professional who is paid on a salaried basis and whose job duties meet the definition of exempt, only has to meet the salary basis for any other exempt, which is $455 per week. They do NOT have to be making a salary that, if broken down to an hourly basis, would reach $27.63.

That's a simplifed explanation and grasmicc or PattyMD might have additional details for you. But too many computer professionals try to divide their salary by the number of hours they work and assume that they are misclassified if the result is not $27.63 or more, and that is not the case.
The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
