  • Withholding Checks

    I am a part time employee in Colorado. The payday at my establishment is every other Monday. Today is Tuesday and i was supposed to have been paid yesterday but my employer has not given out checks because quote "She doesn't feel like doing them today and she doesn't have time!"
    I know this cannot be legal but i wanted a second opinion. Thanks!

    Definitely illegal. That being said, odds are that she hasn't given the checks out because she doesn't have the $$.

      And your recourse is to file a complaint for unpaid wages with the state DOL. YOu might want to see if you get the check today before you do so, however.
      The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
