  • Personnel Files-IL

I requested a copy of my personnel file, but my IL employer said they don't provide copies, but that I can review the file while an HR person is in attendance. Can they do this? I thought a company had to provide a copy if an employee requests a copy.

    Personnel Files

Not in all states. In Illinois, the regulations require that employees can receive portions of their files. However, the employer has the right to charge a fee for the copying. You can read more about this (including what to do when your company does not cooperate) at: http://www.state.il.us/agency/idol/faq/qprecord.htm

My employer has allowed me to review my personnel file, but will not let me have a copy, what can I do?
The Act allows an employee to obtain a copy of the information or part of the information contained in your record, however, the employer is allowed to charge a fee for providing a copy. The fee is limited to the actual cost of duplicating the information. For more information, click here. 820 ILCS 40/3.</FONT>
