  • Paid for On-call? Michigan

    I am a social worker at a not for profit in Michigan.
    Salaried social workers are required to work on-call at least once a week (5pm-9am), and then at least one weekend a month (Fri-Mon)
    We take a variety of calls, as we oversee 3 placement houses, and 65 staff, as well as offer crisis respite.
    We get a variety of calls regarding medication, placements, staffing issues, crisis children, and behavioral issues. We could also need to go in at any time due to crisis placements or behavioral issues.
    We must respond to calls with 10 minutes, and be able to be on-site within 30.
    On average we get between 40-50 calls a weekend, some ranging from 5 mins to some situations lasting hours of calling back and forth.
    For this we get $1 hour.
    Does this seem legal? Should we be getting more? How does it work with salaried employees?

    Salaried is only a pay method and means nothing in and of itself. Are you exempt or non-exempt?
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.

        If you are exempt, there there are no requirements that you ever receive any pay for being on call. An exempt employee is not paid on the basis of how many hours they work, but on the value of the job to the company. There are no circumstances whatsoever under which an exempt employee is owed, by law, any compensation at all beyond their regular salary.

          You said you get $1.00 an hour. Your employer isn't even required to pay
          you that as a salaried exempt employee.
