  • California - Pay Day Issue

    We get paid the 5th and 20th of each month at 5 pm.

    If either of those days land on Saturday, we get paid Friday, if they land on Sunday we get paid Monday, if Monday is a holiday, we get paid Tuesday.

    My question is this... do we owe a duty to the employee that we have to pay them first thing in the morning on that Tuesday or can we pay them at the normal time?

    There is nothing about the time of day in the regs.

    Q. If my regular designated payday falls on a holiday, when should I be paid?


    A. If your regular designated payday falls on a holiday and your employer observes that holiday by closing its business, your employer may pay your wages on the next business day.
