    An employer keeps paying an employee(me) after they quit. Now 20,000 dollars later they figure it out. Is this civil or criminal? do they have to pay it back? what if they can't?

    Of course you have to pay it back. Why on earth do you think the law would say you get to keep $20,000 you didn't earn, were not owed, and were paid in error?
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.

        Why can't you pay it back? Have you been spending this money you knew was not due you? Why would you accept wages not due you - why didn't you inform the company of this instead of waiting for them to figure it out?

          And if it's $20K, it may very likely be felony theft. How are they "requesting" it? Letter? Lawsuit?
