  • Cut my wage to give another a raise? California

    I'm a manger and had sent out a memo reminding my supervisors to avoid filling in for regular employee's spots due to the supervisor's higher pay and billing rate. The director is saying I should have had him review the memo (he had told me in the past), and now we have a supervisor who the company paid him only regular employee's rate rather than the correct supervisor's rate, is complaining that he's under paid, and it started because I didn't let the director review the memo.
    Now my director told me that I'm taking a 15% pay cut because we're cutting budget. But on the other hand, they are correcting the complaining employee's rate to the supervisor's rate, on the same day within an hour, and the difference between the two rates is very close to my 15% pay cut. Basically they're penalizing me by taking part of my wages to fill in what they're giving him to correct his pay rate. Is it legal?

    There is nothing illegal about cutting your wage at the same time another employee is getting a raise, no.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.

      And is it legal for them to cut my way to penalize me for not following certain policy? In this case would be fail to have my director review the memo before I sent it out?

        Unless you have a bona fide, legally binding contract to the contrary, it is legal for them to cut your pay because the Lakers won the NBA championship.
        The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.

          Seriously, agree, your employer did nothing illegal though it may seem unfair.
          (You said you are a manager - are you an exempt employee? Do you still receive a weekly salary of at least $640.00?)

              Ok, then you're still exempt & your employer did nothing illegal in reducing your salary unless you have a bona fide employment contract to the contrary (against this). Sorry.
