    Hello,

    I am a State of California Employee. Recently I was hurt and went on workers comp. During this time I received two regular paychecks on top of my workers comp pay and was overpaid.

    After returning to work my employer deducted $2,600 out of my first paycheck of $2,700 as a partial recovery of the overpaid $6,100.

    This deduction blind-sided me. I thought if I was overpaid I would have been notified first and then offered a payment plan or another means of repayment.

    Can the State of California legally take your whole paycheck each month to recover overpaid salary?
