    You have to pay minimum wage, so it really makes more sense to just pay exactly minimum wage as a draw and to only pay commission to the extent the commissions exceed the draw. Also, you are probably going to run into the Retail Establishement rules.

    I am considering opening a retail location in San Francisco International airport and I am in the middle of structuring my compensation for my employees. The present structure is as such:
    $50 per day, plus 30% commission.
    My understanding of the minimum wage standards for this particular area of San Fran is $11.03 per hour as of 1/1/08.
    My first question is:
    Does the $50 per day need to be considered seperately from the commissions to determine if the employee is acheiving the minimum wage standard? or Is the base pay to be included with the commission to determine this number? My understanding of these laws is that if the employee does not acheive the equivalent of the minimum wage standard that the company needs to pay the difference? Any help would be greatly appreciated!
