West Virginia Business. We had a sick employee with a bad cough we felt was contagious to other employees. We told them to take rest of the week off to get better. This employee is hourly, therefore it was without pay. We currently do not offer any type of sick leave benefit. The employee was willing to work. We felt bad about it, but felt we had to. We can do this, right?

Suppose the person feel better Thursday. Could they come back or do you expect him to stay out until an arbitrary time?

There is nothing wrong with sending someone home sick. The problem I see is you are deciding when the person will be well enough to return. How about ok to return if a Dr releases him? Or are you a physician and know that he will be sick until Friday??
I find that the harder I work, the more luck I seem to have.
