  • New York Uniform Reimbursements

    We currently have 20 restaurants in New York and are using employer provided meals in exchange for uniform maintenance. I'm wondering if we're doing everything we need to in order to be in compliance.

    Do we have to allow the employee to opt out of the meals?

    This is not my area of expertise, but it is my understanding that company provided meals and uniform maintenance are two different things and that one cannot be substituted for the other.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.

      Agreed. The taxability of meals provided by employers are federal rules (IRS) and the deductability of uniform related expenses are federal and state DOL rules. Those agencies barely talk to each other, much less let employers make the decision to offset each other's rules.
