  • Draw v/s Commission/Minimum Pay??? West Virginia

    I once worked at a sales job that paid on a draw v/s commission schedule. The draw was $1700/month. The commission was a sliding scale of 5-7%. The company had a policy that if the salesperson made ANY type of error; pricing, incorrect delivery instructions, phone number, that the commission for the entire sale would be forfeited. It didn't matter if the sale was $200 or $20,000. They sometimes went as far as deducting for a typo.

    Sometimes, the pay difference would be greater than that of the sale. "Losing" the sale would often result in a lower commission percentage. It seemed to me that since salespeople always had to pay back anything lesser than draw, that this was not a fair labor practice. I was informed by the corporate office that as long as they paid minimum wage each week, it didn't matter.

    Does this sound correct?
