    I'm a Accounts Recievable Specialist and I work a 8:00 to 5:00 schudule which is 9 hours with one hour designated unpaid for lunch.

    My duties consist of Billing and Collecting for my employer. I am only one of 5 employees under the expempt salary plan. I often work more then the 40 hours a work week because of the over abundace of work I am required to complete.

    I do not supervise any employees as well as am only able to make decisions under the direction of a collectors manual I had recieved when I had been hired. I am not allowed to make adjustment to billing if over $100 unless I have an okay from my supervisor. I am required to complete and forward my progress on collecting to my supervisor as well as answer to current large balances that are unpaid.

    I'm trying to figure out why I'm an exempt employee?

    I also wanted to know if it is fair that a newly hired exempt salary employee has to wait 90 days in order to be paid for days that the employer closes for holidays?

    Exempt or non-exempt is determined based on "primary" work duties. The above link reviews the exempt classifications.

    For an exempt worker, the worker must be paid the predetermined salary (even if the business closes for a holiday). This is true where the exempt worker has completed work during the course of the workweek. The only time that salary may be docked is where intermittant FMLA exists. This is not the case here.

    To answer your first question, I have a gut feeling that your position is non-exempt. Please review the exemptions listed in the attached link. If you are still unsure after reading through the list, you may contact DOL directly and request a determination of your status.
