  • Promotion to exempt is stalled! California

    I was promoted to exempt as a learned employee in 03, then the law changed in Aug 04.
    “Independent expert” deemed me non-exempt.
    I was then paid fairly for prior overtime worked.
    6/05 I was due a 3% increase which employer promises will be paid retro with 6/06 increase.
    It has been 15 months since I was given a revue or raise.
    Employer wants to promote me back to exempt but claims all the problems are due to payout in 04.
    How can I get the raises and revues I'm due?
    And that all other company employees received on time?

    You are not entitled by law to either raises, reviews or promotions.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
