  • PA Mandatory Overtime for Exempt Employees Pennsylvania

    hi, i was just curious if anyone knows if it is legal in pennsylvania to force exempt employees to work overtime? my dept in a large company is forcing our entire dept to work OT. we are made up of about 50% non-exempt and 50% exempt employees. my question is regarding forced overtime in PA for us exempt employees. i spoke with a friend who is an attorney but whose expertise is not employment law and he wasn't sure, but he thought when i described my job duties, that even though my company designates us exempt employees it appears by our work descriptions and the way we are treated by the company that we are exempt emplyees that are treated like non-exempt workers and therefore they are violating the labor laws for non-exempt workers by not paying us overtime. i guess his point was just because you call someone exempt doesn't meet they necessarily fit that description. can anyone elaborate on this?
