    Written reprimand because I did not come in. I felt this was mandatory overtime as by the time I arrived it would have been at least 1120 and stated this. Other supervisors, charge nurses agree but my union rep thinks I have a poor case. Contract states no mandatory overtime, but also to return to hospital after called within 1/2 hour. Then it would have been an issue of patient abandonment. It seems I am caught in between. How would you approach this given my union rep's comment.( not an rn)

    Your recourse is through your local union and your CBA. If they don't think you have a case - then you probably don't.

      Agree. This isn't a matter of law unless you have worked more than 40 hours already in the workweek. If your CBA provides for OT to be paid under certain other circumstances, that is well and good but if your union rep does not feel your situation falls under these circumstances, you are out of luck.

      Typicallly, the proper thing to do is to show up and grieve the pay issue later and separately. If you just didn't go in when requested based on your understanding of how you would be paid for that time, that is awfully hard to defend.
