  • Covered employment - NJ Family Leave Insurance benefits/unemployment New Jersey

My husband filed for NJ family leave insurance benefits to bond with our son. His contract with his employer had ended, so he applied for family leave benefits during unemployment. His appeal was denied on the ground that he did not work for a NJ employer. He was employed by the NJ office of a staffing agency. The client he worked for was in New York but he was required to work from home in Jersey City for the majority of his hours. He also had NJ FLI benefits deducted from his paycheck. How can we argue that he worked for a "covered employer" in NJ?

Show NJ the paystubs showing FLI deducted. There also should have been employee unemployment and disability insurance (.5% each, if I remember correctly) deducted for NJ if FLI was. It wouldn't make sense if FLI was deducted and EE SDI and UI was not; i.e., subject to one, subject to all three.
