Given that it seems this manager treats everyone rudely, it sounds like she's an equal opportunity jerk and that management tolerates it. While I in no way condone what she said, once incident of calling you retarded doesn't rise to an actionable harassment claim. By all means report it to management. Management's obligation, however, is only to see that the offensive behavior stops, so as long as she doesn't call you that again it means they've done what they're supposed to do. They don't have to make her be nice and not yell at people.

  • Need help with what I should do--supervisor screamed that I was retarded California

Hello everyone, I need some advice here.

At my work (movie theatre) there is a manager who everyone hates. She's very rude to employees and has even yelled at customers before. They've complained and absolutely nothing has happened.

A few weeks ago I called over the radio for more of a particular item (in front of customers) and she began to scream at me like I had just shot her mother. The customers complained and the general manager talked to me about it and nothing happened.

Yesterday, as I was leaving I was walking up the stairs to get my things and I heard her scream "JOHN IS RETARDED!" My name, of course, being John. She screamed this so loud that people outside of the building could hear. There were three other workers there who, they told me, just stood their with their mouths wide open.

I have a brother with down syndrome and when people go around using the word retarded in such derogatory manners it is extremely insulting and I'm very upset.

Tomorrow, I am pretty sure the general manager will be back in and I plan to talk to him but if history repeats itself, which I'm sure it will, nothing will happen.

I am asking you, people of laborlawtalk, what can I do? Please help.

    Thank you very much
