  • 7 Day Rule California California

I have a seasonal employee that is working 6 days a week. Her schedule is 9pm-5am Monday through Saturday. Am I in violation of the 7 day rule in California? Our workweek is Sunday through Saturday.

No mainly because she isn't working 7 days in a work week.

Straight from DIR: California law requires that employers pay overtime, whether authorized or not, at the rate of one and one-half times the employee's regular rate of pay for all hours worked in excess of eight up to and including 12 hours in any workday, and for the first eight hours of work on the seventh consecutive day of work in a workweek, and double the employee's regular rate of pay for all hours worked in excess of 12 in any workday and for all hours worked in excess of eight on the seventh consecutive day of work in a workweek. If the employee isn't working that seventh day no OT is required, assuming daily OT isn't worked.
