    I have recording software installed on one of our production machines. An employee continually surfs the web during regular and overtime hours. Short of termination, can I withhold or dock pay?

    Even though you know how much time is spent surfing, I don't believe you can dock pay for that time (you definitely can't withhold paycheck) but you can discipline up to & including termination. Hold for another responder to verify that.

      You cannot dock pay. You can give a warning either verbal or written; you can fire outright; you can change shifts or duties to less desirable ones; you can reduce pay going forward; but you cannot withhold pay.
      The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.

          Is there any business reason that you have a browser installed on that machine? If not, just remove it. Otherwise, there are ways to restrict browsing that vary depending on your IT configuration (routers, filters, firewalls, etc).
