    I work for a contractor in a refinery, we start at 630 but we have to be in our fire retartant uniform befor work starts, also we are off at 400 but if you clock out one minute early at the gate then we're docked a quarter of an hour?

    Two completely different issues.
    - The easy issue is rounding. Your employer is legally wrong. (29 CFR 785.48)
    - Your other issue (Donning and Duffing) is hard. There are a bunch of court decisions that do not agree with each other. A short answer that is often wrong is that if this is safety equipment that must be worn, then putting it on and taking it off (donning and duffing) should be hours worked. The problem is that there are bunches of other court decisions that come up with exceptions. Many of the court decisions directly contradict each other.
