  • Paying Overtime 40 vs 80 Texas

    I have worked in a company where they pay over time for any hours worked over 80 and they pay every other Friday or a bi-weekly basis.

    The company I am working with now says that they have to pay overtime for any hours over 40 even though our pay schedule is based on 80 hours and we are paid bi-weekly also.

    I just want to make sure the employees are getting paid correctly if we have it set up for paychecks to be distributed every other Friday.

    Do we pay overtime at 40? Or do we pay overtime at 80?

    Unless you are in the healthcare field, and only sometimes there, you pay OT after 40 hours in a week. Only certain health care providers may legally pay OT based on 80 in a pay period vs. 40 in a week.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
