I have a employee that wants to work and not clock in and not get paid for it Because she is not allowed to get over 40 hours per week

Bad move. The employer must pay for all work performed. If over 40 hours in a week, you are looking at OT also.

Do not allow the employee to do this.
I find that the harder I work, the more luck I seem to have.
