    The rate at which vacation pay is paid is not addressed in Pennsylvania law. I agree it doesn't seem fair, and many companies will pay paid time off at least at minimum wage for tipped employees, but in your state, there is no law that requires them to do so, I'm sorry to say.

    PA minimum wage and vacation pay

    I am a tipped employee and my normal wage payed by my employer is $2.83/ hr. My employer offers paid vacation to all full time employees. The vacation pay is payed at the beginning of the year, then if you take your vacation you do not receive any other compensation for that time. All employees receive there normal wages for their vacation pay, but this leaves the tipped employees getting $2.83/ hr. I'm guessing this is a legal practice, but I just wanted to check here.
