    I have recently started an overnight fast food job. I don't mind it too much except for one thing, I'm not allowed to go outside on my lunch break. In fact, from midnight to five in the morning, no one is allowed out unless their shift ends. People are coming in to work at 2:30 in the morning and I'm still not allowed to go outside to have a cigarette. It is not legal in Oregon to smoke in the workplace (at least to my knowledge) but is it legal to lock me inside on my unpaid break?

    Yes, it is. A rest break is paid time. I would imagine they are concerned not only for your safety, but for their liability were you to be injured on your meal period. If you are completely relieved of duty for the meal period, the fact that you cannot leave the facility does not make the time compensable.
