  • Wrongfully accused of calling someone "Racist"

I have been wrongfully accused of calling someone "racist". He told HR that I called him "racist" on march 16 in the stairs, but has no proof. I do not even remember seeing him in the stairs.

HR has scheduled a meeting with him and me on Monday (March 27th).
15 months ago, this man told me to "speak english" when i had asked him a question, but denied saying anything when I complained.

I think that this is retaliation against me since I had complained.

Can I be fired and what can I do legally ?

I work in NY (Nassau County)

    Thank You,

You are going to have an enormously difficult task in convincing anyone (including me, sorry) that this is retaliation for a complaint made well over a year , particularly since the complaint you made would not be a protected complaint based on the facts you have provided.

This is a matter of company policy. Nothing you have posted invokes any laws or legal protections. The company can fire either or both of you.
The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
