  • Mandatory OT for non-exempt NY Emp New York

Can an employer make overtime mandatory in the state of NY for non-exempt employees?

If so, can the employer discipline the employee for the refusal of working the mandatory overtime?

Thank you for all your help, it is very much appreciated.

With a very few industry specific exceptions, the answer to your first question is yes, in all 50 states.

The answer to your second question is also yes in 48 states, including NY.
The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
