    The law requires that you be paid for all the hours you work in the paycheck for the period in which you worked them. It doesn't matter whether it was over 40 hours or under; you do not have the option of banking them for use later.

    I am scheduled to work 5 days a week for 6 hours a day for a total of 30 in a week. I generally work more hours, but not more than 40. I am paid every two weeks. The extra hours over the 30 per week I banked and took off during the summer when things are slower in my position. It has been brought to my attention that I am in violation of the law. I have done some research and thought that as long as I was not a 40 hour a week employee or that my extra hours did not constitute overtime that this would just be a wash. I like the idea of having the same pay every two weeks and being able to take off during the summer with the hours I have worked, but not been paid for. Please advise. Thank you!
