    Our manager won't let us punch in at our scheduled time if it is too slow(waitress). Is this legal?

    I assume you're a non-exempt employee. You probably have to be paid for this time before you punch in.

    If your employer has you physically at their place of work, that is generally hours worked -- If you can't use this wait time effectively for your own purpose but must at all times be ready to act when work becomes available. This would usually be considered "engaged to wait" & the inactive time considered hours worked.
