    A friend of mine is an hourly employee and if for some reason she does not work the full 40 hours they take it out of their PTO. What if the employee does not want it taken out of their PTO? This company is saying it is a requirement.

    This is perfectly legal. Employers are legally free to dictate when their employees' PTO is used.
