Illinois Non Compete Laws Illinois

I am a sales rep who signed a non compete for a company in Illinois. Shortly after, my company transfered me to Colorado where I have been working for 3 years. I recently got an opportunity to work for a direct competitor back in Chicago and I want to take the position. Will my non-compete in Illinois be enforceable given that my current customers are in Colorado and my new job would be in Chicago?

To be on the safe side, you should always take your non-compete to an employment or contract attorney for review & advice. (Il. attorney)

I might add this is how Il. courts view non-competes. (see below) You still need to take it to an Il. attorney for review & advice as to its enforceability. They should know what the Il. courts consider as "reasonable & necessary." I know your customers are in Colorado but you will work for a competitor in Il. where you signed the non-compete.

Non-competes are enforceable if the terms are reasonable and necessary to protect a legitimate, protectable business interest of the employer. Non-competes must be reasonable in regard to time, territory, and activity restrictions.
